These Terms of Use ("Terms") govern your access to and use of Kira - AI Nutritionist ("Kira", "the App", "we", "us", or "our"), operated by RM Software Solutions. By downloading, installing, or using Kira, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 16 years old to use Kira. By using the App, you confirm that you meet this age requirement and that you have the legal capacity to enter into these Terms.

2. Description of Service

Kira is a nutrition tracking application that provides:

  • For Members: AI-assisted meal scanning and analysis, macro tracking, personalised nutrition guidance, and access to trainer coaching.
  • For Trainers: Client management tools, nutrition planning, progress monitoring, and coaching communication.

Kira is intended for general wellness and informational purposes only. It is not a medical device, and nothing in the App constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making significant changes to your diet or exercise routine.

3. Accounts

You must create an account to use Kira. You are responsible for:

  • Providing accurate and current information at registration.
  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.

You must notify us immediately if you suspect unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Paid Plans

Kira is offered on a subscription basis. Subscription fees are charged through the Apple App Store in accordance with their payment terms. All pricing is displayed in your local currency at the point of purchase.

Subscription options may include monthly and annual plans with varying features for members and trainers.

Payment will be charged to your Apple ID account at confirmation of purchase.

4.2 Free Trials

Where a free trial is offered, it will begin on the date you initiate the subscription. At the end of the trial period, your subscription will automatically renew at the standard rate unless cancelled before the trial ends.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. The renewal price will be the same as the original subscription price unless otherwise disclosed at the time of purchase. You can manage or cancel your subscription at any time through your Apple ID account settings.

4.4 Refunds

All payments are processed by Apple. Refund requests are subject to Apple's refund policy and must be submitted directly to Apple.

4.5 Restore Purchases

If you reinstall the App or switch devices, you may restore your active subscription using the "Restore Purchases" option within the App.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or tamper with the App.
  • Share your account credentials with others.
  • Upload content that is false, harmful, offensive, or infringes third-party rights.
  • Use the App to harass, impersonate, or harm other users.
  • Attempt to circumvent subscription enforcement or access paid features without a valid subscription.

6. AI-Generated Content

Kira uses artificial intelligence to analyse meal images and provide nutritional estimates. You acknowledge that:

  • AI-generated macro and calorie estimates are approximations and may not be accurate.
  • Results depend on the quality of images submitted and the completeness of information provided.
  • AI outputs may be incomplete, incorrect, or unsuitable for your individual circumstances.
  • AI outputs should not be relied upon as a substitute for professional dietary advice.
  • We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.

7. Trainer-Client Relationships

Where Kira facilitates a relationship between a trainer and a member:

  • Trainers are independent users and are not employees or agents of RM Software Solutions.
  • We do not verify the qualifications, credentials, or fitness of any trainer.
  • Members engage with trainers at their own discretion and risk.
  • Any disputes between trainers and clients are solely between those parties.

8. User Content

By submitting content to Kira (including meal photos, profile data, and messages), you grant us a limited, non-exclusive licence to store, process, and display that content solely for the purpose of providing the service. You retain ownership of your content. We do not sell your content to third parties.

9. Privacy

Your use of Kira is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we collect, use, and protect your data.

10. Intellectual Property

All content, design, code, trademarks, and materials within Kira are owned by or licensed to RM Software Solutions. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

11. Disclaimers

To the maximum extent permitted by law:

  • Kira is provided "as is" and "as available" without warranties of any kind.
  • We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
  • We do not guarantee any specific health, fitness, or weight-related outcomes from using the App.
  • We are not responsible for decisions made based on information provided by the App.

12. Limitation of Liability

To the maximum extent permitted by applicable law, RM Software Solutions shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, loss of revenue, or personal injury. Our total liability to you shall not exceed the amount you paid for the App in the 12 months preceding the claim.

13. Termination

We may suspend or terminate your access to Kira at any time if you breach these Terms or if we discontinue the service. Upon termination, your right to use the App ceases immediately. Sections 8-15 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Continued use of Kira after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
